Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual (including the information below) as “Personal Information.” See the list below for more information about what Personal Information we collect and why.

  • Device information
    • Purpose of collection: To load the Site accurately for you, and to perform analytics on Site usage to optimize our Site
    • Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels. 
    • Disclosure for a business purpose: Shared with our service providers, including Shopify, who assist in fulfilling orders, marketing our products, or operating this Site, such as data hosting, data processing, analytics, and billing, provided that such parties are obligated to keep this information confidential. The information collected on this Site also may be used by Shopify, Verbatim and its service providers to analyze trends, administer the Site, diagnose technical problems, derive each user’s approximate location, determine unauthorized use, calculate user levels, perform audits, and for security and fraud monitoring and detection.   Information about use of the Site helps Verbatim measure the success of our advertising, the Site and its features or pages and to improve your online experience.  The information may also be used for records administration, accounting and funding activities, enforcing Site policies, and compliance with laws and regulations. 
    • Personal Information collected: The language and version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site, date and time of request, content of request, HTTP status code, size of transferred data, referrer, operating system and GUI version.
  • Order information
    • Purpose of collection: To provide products or services to you to fulfill our contract, to process your payment information*, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
    • Source of collection: Collected from you.
    • Disclosure for a business purpose: Shared with our service providers, including shipping companies and including Shopify,  in order to process and fulfill your order and to notify you of your order status.  Shopify will maintain a customer profile on you that Verbatim can access to see your order status, shipping information, order history, email address, shipping address and phone number, and related information that you provided in ordering you product. 
    • Personal Information collected: Name, billing address, shipping address, payment information (including debit cards, PayPal, GooglePay, ApplePay,  Shop, ShopPay, credit card numbers ), email address, phone number, order history, and any personal information that you choose to provide to us in a comment or review.  Shopify will maintain a customer profile on you that Verbatim can access to see your order status, shipping information, order history, email address, shipping address and phone number, and related information that you provided in ordering you product.

    • Purpose of collection: To provide customer support.
    • Source of collection: Collected from you.
    • Disclosure for a business purpose: Shared with our service providers to respond to inquiries and requests 
    • Personal Information collected: Your name, phone number, shipping address if applicable,  email address, and any information that you provide to our customer service support personnel.

*Our online store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.  According to our agreement with Shopify, Shopify processes your credit and debit card numbers if you use a payment card to pay for the products you purchase on this Site.   Shopify does not share this information with Verbatim and Verbatim does not have access to it.  

Minors

The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address above to request deletion.

Sharing Personal Information

We share (disclose) your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We use Shopify to power our online store. Please see Shopify’s Privacy Policy and read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.  Shopify has represented to us that it uses the information that it collects and receives only for purposes of providing the services requested by Verbatim.
  • Verbatim (and its affiliates and service providers) may disclose any information that it collects and retains when we believe we are required to do so in order to comply with the law or regulation (including foreign laws applicable to our affiliates and service providers), enforce our policies, to defend against legal claims, to address misuse of the Site (including without limitation unauthorized access to any system, spamming, denial of service attacks or similar attacks), or protect ours or other’s rights, property, or safety. By using a Site, you consent to such disclosure.
  • Verbatim also may disclose the information collected for our business purposes to parties connected with the proposed or actual financing, insuring, sale, assignment or other disposal of all or part of Verbatim or our business or assets, for the purposes of evaluating and/or performing the proposed transaction. Assignees or successors of Verbatim or our business or assets may use and disclose the information collected for similar purposes as those described in this Privacy Policy.
  • For the avoidance of doubt, Verbatim may use non-personal and anonymized, non-identifiable summarized, derived, or aggregate information in any manner to the fullest extent permitted by applicable law, and nothing in this Privacy Policy precludes or restricts Verbatim’s use of such information. We may aggregate and anonymize personal information to create such data.
  • Verbatim may also share your personal information with others, including lawyers and other service providers, to comply with and fulfill our legal obligations.

Analytics and Behavioral Advertising

Using Personal Information

Retention

When you place an order through the Site, we will retain your Personal Information for our records.  We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information, and in most cases we use the purpose for which we collected the personal information to determine the length of time that we need to retain it.  In some instances, such as when required by law, we may retain the information for a longer period.

 

Contests, Promotions, and Reviews

If you participate in a contest or promotion on this Site, we collect the personal information that you submit and share it with judges as well as Verbatim employees who are working on the event.  If you are a winner, we may share your information with the public by posting the fact that you are a winner on our Site and we will share your address with a shipping provider to deliver any prize.  Our contests and promotions are voluntary, and by participating you consent to such collection, use and disclosure.  Likewise, if you provide a comment or review of our products on our Site intended for sharing with others, the content and your name may be publicly available. Please note that if you submit material for public posting, we are not able to control what third parties may see it, or what they may do with such information. You should always exercise caution when posting information publicly. We are not responsible for the actions of these third parties.

 

How We Protect Your Personal Information 

Verbatim uses commercially reasonable technical, physical and organizational security controls to protect loss, misuse and alteration of, and limit access to, all non -public collected information about you.  This Site is hosted by Shopify.  Shopify represented to us that it implements and maintains appropriate technical and organizational measures to protect  personal information against unauthorized or unlawful processing. Internally, we employ measures designed to limit access to personal information about you to employees whom we reasonably believe to come into contact with the information for the purposes set forth in this Policy.  These measures are designed to protect such personal information from unauthorized persons when you are using the Websites. Unfortunately, data, including without limitation e-mail and electronic communications, submitted over the Internet is subject to the risk of being accessed by unauthorized third parties. No security system is fail safe and Verbatim cannot guarantee the information you provide will never be obtained by unauthorized persons. You have the right to use an authorized agent registered to do business in California to submit Data Deletion Requests and Data Access Requests, but Verbatim will require you to provide the authorized agent written permission to do so, verify your identity with the business, and directly confirm that you provided the authorized agent permission to submit the request,  except if your authorized agent has a proper power of attorney.  Verbatim may deny a request from an authorized agent if the agent does not submit proof that the agent has been authorized by you to act on your behalf.
